Terms & Conditions
Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern The Beach House Water Company's and Sunstone Trading's relationship with you in relation to this website. In these Terms and Conditions "Company" means "The Beach House Water Company" & "Sunstone Trading Co." and "Customer" means the person or company that purchases the goods. "Goods" means the goods specified in the Companys invoice.
- These terms and conditions apply to all contracts for the sale of Goods to the Customer to the exclusion of any terms and conditions specified by the Customer.
- All prices quoted in any form are subject to confirmation at time of order and are inclusive of VAT.
- Quotations:
Our quotations for any goods are only valid on the day of issue and are also subject to stock availability. All quotations are for the sole use of the addressee and we reserve the right to withdraw a quotation, which has been passed on to a third party. - Catalogues & Brochures:
All descriptions and illustrations of goods on our website, in any catalogues, brochure, e-mail shot, price list or in any other document provided by the Company are intended for general guidance only and do not form part of any contract between the company and the customer or potential customer. The Company accepts no liability whatsoever for any error or omissions in such documents and cannot be liable in any circumstances for any loss or damage resulting from the customers reliance on such descriptions and illustrations. - Payments are made in full, prior to the receiving of goods.
- Deposits on Sales agreements are only valid, once past on to us and acknowledged with a receipt from us. No Sales Agent or Dealer is authorized to issues such receipts.
- Title in all Goods supplied by the Company shall vest in the Company until the Company has received full payment in respect thereof. Risk in Goods supplied passes to the Customer on dispatch.
- The Company warrants to the Customer only that any Goods supplied by it, function in accordance with any specification provided in documentation accompanying the Goods, provided always the Goods have been used strictly in accordance with the Company’s instructions, and, without prejudice to the generality of the foregoing, have been used correctly or installed correctly.
- The Company as herein provided, all representations, conditions, warranties or other terms whether expressed or implied or whether statutory or otherwise are hereby expressly excluded. Under no circumstances shall the Company be liable to the Customer or to third parties for loss (including, but not limited to, loss of profit or data) damage or injury howsoever arising. In any event, the total liability the Company shall have to the Customer shall not exceed the value of the Goods covered by the invoice.
- In the case of Goods not of the Company’s manufacture, the Company will extend the Customer the benefit of any guarantee, warranty or condition which may have been granted to the Company by the supplier of the Goods and will take such steps as the Customer may reasonably require to enforce such rights but save as aforesaid no condition or warranty is given by the Company in relation to such Goods that are not of its manufacture. The warranties in this clause in no way invalidate any statutory right of the customer.
- In the case of any goods being defective or malfunctioning the Customer is requested to notify this to the Company immediately (not longer than 3 days), after noticing it. Failure to do so, renders all warranties and potential claims to damages void.
- All goods supplied by the Company are intended for use and installation in the European Union. Any other sale to other countries is subject of approval through the company.
- Terms of Delivery:
Late Delivery: Whilst the Company use its best endeavors to deliver the Goods in accordance with the Buyer's requirements, we will not be liable for any consequences of late delivery howsoever caused. All claims made in respect of partial or total non-delivery of goods must be received in writing within 5 working days from the date of delivery (addressed to: The Beach House Water Company / Sunstone Trading Co., Ring, Clonakilty, Co. Cork, Ireland or by e-mail to: info@beachhouse-sunstone.com). All claims made for damaged products must be received in writing within 5 working days from date of delivery (addressed to: The Beach House Water Company / Sunstone Trading Co., Ring, Clonakilty, Co. Cork, Ireland or by e-mail to: info@beachhouse-sunstone.com). - Carriage:
All carriage costs for returned goods are carried by the Customer. In any case all carriage costs made by the customer are not subject to claim. - Force Majeure:
The Company reserves the right to cancel, vary or suspend the operation of contract of sale if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing) fire, floods, storm, plant breakdown, strikes, lock-outs, riots, hostilities, non-availability of materials or supplies or any other event outside the control of the Company and we shall not be held liable for any breach of contract resulting from such event. - Data Protection:
In the course of dealings with the Company you will supply to us data which we will collect and retain. Some or all of that data may be personal data that is subject to the Data Protection Act 1988. The data supplied to us will be processed by us to execute your order, to monitor your account, to select and send to you marketing material. You consent to the processing of your data for those purposes.

- Corporate Governance (Governing Law):
Our contract of sale shall be governed by, & subject to, the laws of the Republic of Ireland & any disputes arising during the course of trading will be subject to the jurisdiction of the Irish courts.
